Tesla is on trial for a racial discrimination lawsuit brought forward by Black employees at its flagship plant in California, The Guardian reports.

The outlet notes that dozens of those employees have brought forward allegations that involve racial slurs, among other offenses. The lawsuit dates back to February 2022 and accuses the automobile and energy technology company owned by Elon Musk of failing to comply with California’s Fair Employment and Housing Act.

During a trial that began on Monday, Sept. 21, California Civil Rights Department lawyer Brett Watson shared photos taken of the Fremont, CA, factory that displayed the N-word on a metal surface and on a wall. Court documents also revealed that swastikas, the Confederate flag, “KKK,” and the message “go back to Africa” were seen in workplace bathrooms and lockers as well as benches and tables, the outlet reports.

A Black employee claims he was asked, “You want to hang from a tree?” Also the factory was described by workers as “the plantation,” a “slave ship,” and “The Elon Slave Labor Association,” which spells out TESLA, The Guardian reports.

Other Black employees describe experiencing “rampant racism,” with one claiming to hear as many as 100 instances of racial slurs each day, per the outlet.

“Despite what Tesla might argue, you will hear Black workers were deeply offended,” Watson said, according to The Guardian. “These experiences cannot be dismissed as a few bad apples… hundreds of complaints to Tesla and [the Civil Rights Department] will show these experiences were not isolated.”

Other allegations include unfair pay, routine bullying from supervisors, fewer promotions, and a lack of action from management, the outlet notes. The 2022 lawsuit’s allegations also include racial segregation at the factory and higher rates of termination for Black employees compared with white counterparts.

The lawsuit seeks financial damages as well as injunctive relief to compel Tesla to change its policies and practices around work and labor, The Guardian reports.

Tesla claims the lawsuit is “misguided” and says it has “always disciplined and terminated employees who engage in misconduct, including those who use racial slurs or harass others in different ways.”

The bench trial is expected to conclude by late October, with Judge Peter Borkon deciding the matter instead of a jury.
